The current solid waste ordinance reads as follows:
Garbage operations; penalty.
(a)
No person, firm or corporation, or its agents, servants, or employees, shall conduct garbage operations in the City of Valley, Alabama, or its police jurisdiction in such a manner as to disturb the peace of the residents of the City of Valley, Alabama or its police jurisdiction.
(b)
Commercial solid waste collection operations which cause or create unreasonable noise, are hereby prohibited between the hours or 9:00 p.m. Eastern Time and 6:00 a.m. Eastern Time. Residential solid waste operations which cause or create unreasonable noise, are hereby prohibited between the hours of 9:00 p.m. Eastern Time and 8:00 a.m. Eastern Time.
(c)
Any person, firm or corporation, or its agents, servants or employees who violate the provisions of this ordinance shall be punished, upon conviction, by fine of not more than $200.00 and/or by imprisonment at hard labor for the city for not more than six months, at the discretion of the judge trying the case.
Disposal of refuse in city prohibited; penalty.
(a)
It shall be unlawful to dump, deposit or dispose of any refuse on any lot, public street, alley or roadway within the city, unless an application for the designation of a disposal area showing such use of the area has been authorized by the city. The location of and boundaries of such disposal areas must be filed in the office of the city clerk and must be approved by the city council prior to use as a disposal area and who shall have authority to impose restrictions on the type of disposal.
(b)
Any person who violates this section shall be punished as provided in section 1-11.
The city contracted with C&C Sanitation out of Lagrange to take over trash pick up beginning in January replacing Amwaste which had the contract previously. Amwaste has been the subject of frustrated citizens due to slow pickup during the holidays as well as the pickup of Amwaste trash cans.
Requirement of portable toilets to be established upon construction sites within the municipality, and governing their usage elsewhere.
Portable toilet facility: a self-contained portable unit that acts as a storage chamber into which human waste is to be deposited.
Construction site: any residential, commercial, industrial, or other areas, lot, or site in which construction or demolition of any type is conducted including roads.
When not provided with a sanitary sewer upon the site, the owner, agent, or contractor in charge of any construction site shall furnish no less than one portable toilet facility on such site, but in any event, the number of portable toilet facilities shall be as prescribed by the United States Department of Labor Occupational Safety and Health Administration regulations
and in such number so as to sufficiently serve the sanitary waste needs for the site. It shall be unlawful for the owner, agent, or contractor in charge of a construction site to cause, permit, or allow such facility to spill or discharge on the site or into waters located on the site, and such portable toilet facilities shall be located upon the natural ground and not upon impervious surfaces nor upon any street or public right-of-way. It shall be the responsibility of the owner, agent, or contractor in charge of a construction site to have such facility emptied, serviced, and maintained at least once every 15 days.
No person, firm, or corporation owning land, leasing it, or having any interest in it whatsoever, which is located within the city limits or police jurisdiction, shall allow the placement or use of a portable toilet facility upon their property. The provisions of this sub-section shall not apply to:
Temporary use sites in which the portable toilet facilities will be removed within 96 hours of placement, such as special events, auctions, or parades;
Temporary use when a sanitary system is being repaired or replaced, not to exceed 15 days without approval by the director of environmental services, or his designee;
During periods of a disaster declaration made by the local governing body.
Any violation of this section shall be punishable as provided in sections 1-11.
The Council will discuss the review of the solid waste ordinance at the next Council Meeting on Monday, February 13th.
